Plain and Simple Details About Our Terms of Service ..

The use of services from Smart Framework [hereafter referred to as "SF"] constitutes agreement to these terms. SF users are entirely liable for all activities conducted through your administrator and all your end clients accounts. The following terms of service are designed to provide the highest level of service available.

All services provided by SF ("SMART FRAMEWORK") may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Smart Framework from any claims resulting from the use of service which damages the subscriber or any other party. Prohibited are sites that promote any illegal activity or present content that may be damaging to Smart Framework's servers, or any other server on the Internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:

-Pirated software

-Hacker programs or archives


Server Abuse

Any attempt to undermine or cause harm to a server or customer of Smart Framework is strictly prohibited. As our customer you are responsible for all your accounts. Should you violate the Terms of Services outlined within, your account will be cancelled without chance of refund.

Refusal of Service

We reserve the right to refuse, cancel or suspend service, at our sole discretion. All sub-networks, distributive hosting sites and dedicated servers of SF must adhere to the above policies, with the exception of system resources in respect to dedicated servers.


By the Account Activation Date of each month, SF shall either: -Debit the client's credit card on file. -Deliver, by e-mail or regular mail.

An invoice in accordance with the applicable Service Fees for services rendered for the current month. When an invoice is delivered to the client, payment shall be remitted to SF by no later than the specified payment due date. SF shall be entitled to immediately terminate this agreement for client's failure to make timely payments. You will be provided with an invoice on a monthly basis. It is the client's responsibility to ensure that they have deposited funds to cover this transaction.

If we do not receive a response within 24 hours, the account, and all accounts under that account plan, will be suspended.

Service Fees

Certain services carry a setup fee charged by SF to client, which must be paid by client in order to have use of said services. If client terminates this agreement, client shall be responsible for any and all outstanding fees owed to SF and agrees to pay any and all fees incurred by client. Because the services are provided on a monthly basis, the client will be responsible for service fees incurred each month, regardless of when client provides notice of termination. Thus, for example, if the client provides notice of termination on the 15th day of a particular month, the client will be responsible for service fees for the entire month, and such fees will not be pro-rated or refunded.

Refusal of Service

We reserve the right to refuse, cancel or suspend service, at our sole discretion.

Limitation of Liability

SF shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from SF's servers going off-line or being unavailable for any reason whatsoever. Furthermore,  SF shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of SF 's servers. All damages shall be limited to the immediate termination of service.


Violations of these Acceptable Use Policies should be referred to [email protected]. All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.

Server Uptime Guarantee

SF's goal is to provide 100% service (http, ftp, pop, imap, smtp) uptime on all hosting plans.


We may suspend your Services without liability if:

(i) we reasonably believe that the Services are being used (or have been or will be used) in violation of the Agreement,

(ii) we discover that you are, or are affiliated in any manner with, a person who has used similar services abusively in the past;

(iii) you don’t cooperate with our reasonable investigation of any suspected violation of the Agreement;

(iv) we reasonably believe that your Services have been accessed or manipulated by a third party without your consent,

(v) we reasonably believe that suspension of the Services is necessary to protect our network or our other customers,

(vi) a payment for the Services is overdue, or (vii) suspension is required by law.  

We will give you reasonable advance notice of a suspension under this paragraph and a chance to cure the grounds on which the suspension is based, unless we determine, in our reasonable commercial judgment, that a suspension on shorter or contemporaneous notice is necessary to protect SF or its other customers from imminent and significant operational or security risk.


On shared/Reseller/Master Reseller hosting, We give 15 days after the due date for hosting account termination. After that, your hosting account will be terminated. For VPS/Dedicated servers, there are no grace period, this mean the server will be terminated just after the expiration date.

On Shared/Reseller/Master Reseller hosting, your hosted domain must be pointed to our server, if not its will be detected by our system and suspended the hosted account. If you don't take necessary action to resolve the issues, the unpointed hosted account in suspended state more than 30days will be terminated.

After the termination, all data will be deleted parmanently and no backup is possible after that. So, if you do not want to continue the hosting service, but you want to keep your data, then please take a backup of your necessary data before the expire date.

Backup System

In our Shared Hosting, Reseller Hosting, Master Reseller Hosting Server environment there is no Data Backup system available.

If you take Shared Hosting, Reseller Hosting, Master Reseller Hosting You need to take backup own.

If you need backup system, you can purchase separate remote backup storage.

If there is any data loss or destroy, customer will provide data & Smart Framework will help to restore data.

Mail sending limit

We give up to package wise email account creation option & there are no limits in receiving mail, but We strictly do limitations in mail sending which one is hourly 5-20 for per account, also daily max 50-100 for per account.

Because we don’t allow spamming/abuse & also note that it’s a web hosting, not mail hosting. We strongly suggest to use a mail exchanger to use professionally.

IP Blacklists

If any Customer or any Third Party User that is a customer of our Customer uses SF Networks services, network, or its physical Information in a manner that causes SF Networks, or any IPs issued by SF Networks to be blacklisted or blocked, SF Networks reserves the right to suspend or terminate services of such customer and/or suspend or terminate the access to services, network, and/or its physical Information. Operating SF Networks service on behalf of, or in connection with or reselling any service to persons or firms listed in the Spamhaus Register of Known Spam Operations database at www.spamhaus.org shall constitute a violation of this AUP.


Users are prohibited from violating or attempting to violate the security of the SF Networks. Violations of system or network security may result in civil or criminal liability. SF Networks will investigate occurrences, which may involve cooperation with law enforcement authorities in prosecuting Users who are involved in such violations.

These violations include, without limitation:

i) Accessing data not intended for such user or logging into a server or account, which such user is not authorized to access,

ii) Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization,

iii) Attempting to interfere with service to any user, host or network, including, without limitation, via means of 'overloading', 'flooding', 'mail bombing' or 'crashing',

iv) Forging any TCP/IP packet header or any part of the header information in any e-mail or forum posting,

v) Taking any action in order to obtain services to which such User is not entitled,

vi) Attempting to couple many hosting packages together to take advantage of massive space or bandwidth allocations,

Each hosting package purchased is unique to a do main name and use - you are not allowed to purchase multiple plans to obtain combined bandwidth & space.

SF Networks will stop such transactions and label them as deceptive. We have an upgrade path for all services and we can often times work out special deals for users if they ask us for the assistance.

Violations of system or network security are prohibited, and may result in criminal and civil liability. Examples include, but are not limited to the following: Unauthorized access, use, probe, or scan of a systems security or authentication measures, data or traffic. Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks. Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

SF reserves the right to amend any or all of the above policies, guidelines and disclaimer without notification. We also retain the right to increase any pricing and make changes to our account plans without notification.
